The terms and conditions listed below define the relationship between the User and \u0110or\u0111e Bojkovic PR Web Hosting PIB 111318581, hereinafter referred to as the Provider, regarding the service that the User has chosen.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li id=\"2\">Services<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">2.1 Web hosting services, VPS servers, domain registration, site management services, administration services, account changes, as well as other pre-arranged services between the User and the Provider. The pre-bill and the bill define which service is used and paid for.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2. Provajder ima pravo da u bilo kom trenutku promeni uslugu ili okon\u010da uslugu delimi\u010dno ili u celosti ukoliko je potrebno iz bilo kojih razloga, tehni\u010dkih ili iz zakonskih regulativa nadle\u017enih organa, u skladu sa ta\u010dkom 6.9 ovih Uslova.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3 The provider will provide technical support during the period of service provision via LiveChat or Email as well as via information on the site itself. Support response times are not guaranteed or time limited. The provider will try to make the response time as short as possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.4. Data and information about the User may be forwarded to a third party if it is necessary to ensure the proper functioning of the service (for example, technical support of software used on hosting). In this case, special care will be taken to protect the user&#039;s information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.5. The Provider will register the domain on behalf of the User and the User is the owner of that domain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.6. The user must be at least 18 years old in order to be able to order the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.7. The Provider may refuse to provide services to anyone if it believes that the User is in any way endangering or may endanger the servers or business. The provider reserves the right to refuse cooperation with anyone and to provide services to anyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.8. Abuse of support and communication restrictions<br>Support is intended to resolve hosting issues. We reserve the right to limit or suspend support per individual topic or communication channel, if the user:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>repeats the same request without providing the requested information (screenshot, error message, logs) after 2 consecutive support requests; or<\/li>\n\n\n\n<li>opens multiple consecutive conversations for the same problem without new information; or<\/li>\n\n\n\n<li>requires actions that do not fall within the scope of support (adjustment or debugging of the application\/code, changes in site files instead of the user); or<\/li>\n\n\n\n<li>interferes with the work of support with an excessive number of messages (spam), by insulting or pressuring the support to work outside the defined rules.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In these cases, support can:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>redirect communication exclusively to email; and\/or<\/li>\n\n\n\n<li>close the conversation on that topic; and\/or<\/li>\n\n\n\n<li>temporarily disable live chat for the user.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The assessment of abuse and the application of restrictions is carried out by the service provider, guided by the above-mentioned criteria and the interest to ensure normal work of support for all users.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li id=\"3\">Contract duration and service provision<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The period of service provision is chosen by the User when placing an order or by changing it from the Client-Panel. The user can terminate the contract at any time by deleting the service from the Client Panel. The change of the service period will be confirmed in the invoice, but the change of the period cannot be done while there are unpaid invoices, in which case it must ask the Provider to delete the unpaid invoices in order to change the payment period and thereby generate a new invoice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2. The provider reserves the right to refuse to delete the pre-bill for any reason.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.3. Termination of the contract regarding the domain is possible, however, the domain remains in the registration status until its expiration even after the termination of the contract, but the user deleting the domain from the Client-Panel will not receive invoices for the extension of that domain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.4. Each of the contracting parties will have the right to send a written notice of termination of the Agreement by email. Termination will be effective immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.5. The Provider has the right to terminate the service with immediate effect, the Provider will have the right to stop providing the service until the investigation is completed. The provider also has the right to terminate the service as a result of a police report, investigation, dispute, etc. related to the service, where the Provider considers it necessary to prevent criminal activities or similar actions that may affect such cases. The provider has the right to terminate the service if the software on the user&#039;s account is outdated or contains security flaws or potentially dangerous content (malware, virus, infected file or code that enables the distribution of viruses, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.6. The provider is not obliged to send a notification by email about the termination of the service from the specified items of point 3.5 of this contract. If there is an agreement between the Provider and the User that the User will solve all problems on his account and in connection with the Services used, the provider can reactivate the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.7. The Provider may terminate the service if the User violates any law of the Republic of Serbia and the laws of other countries by using the service, as well as if the Provider receives a report (abuse email) from third parties for copyright infringement or distribution of malicious software or phishing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.8. The 99.9% uptime guarantee does not include periods of unavailability caused by factors beyond the Provider&#039;s control, including but not limited to: data center technical interventions (e.g. hardware replacement), time required to restore data from backup servers, or force majeure (e.g. natural disasters, hacker attacks).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.9. The provider may terminate or temporarily suspend the service if the site\/sites\/account is under a DDoS attack or other hacker attack.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li id=\"4\">Service Fee<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. Activation of the service implies a one-time charge for starting and providing the service for the contracted period, and renewal is charged for the extension of that period. By activating the service, it is considered that the service has been performed. The user expressly requests the execution to begin immediately by consenting to the purchase.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2. Payment for the service is made no later than the day before the expiration date. The user must take care that the payment order is filled out correctly with reference to the number as well as the purpose of the payment so that the payment can be verified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.4. The provider will send the user several invoices about the renewal of the service he has through an automated system to the email address for payment. The user must make the payment according to the last invoice he receives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.5. The provider will have the right to suspend the service if the User does not pay the invoice on time or if he has not completed the payment correctly or if the full amount of the pre-invoice has not been paid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.6. A change in the amount of the service\/proforma invoice\/service invoice can also occur during the term of the account if there has been a price change or if there was a current promotion at the time the proforma invoice was created. The user is obliged to inform himself whether there has been a change in the amount of the additional account that he wants to pay immediately before payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.7. If the provider terminates the service due to the violation of the contract by the User, the user cannot request a refund and the User himself is responsible for all damages resulting from the violation of the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.8. Service that has not been renewed will be disconnected immediately upon expiration. The provider will keep the web hosting services in a suspended status for another 30 days in case the user still wants to continue using the services. The provider does not guarantee that this will always be the case, the only guaranteed period is for the duration of the service until its expiration. After the end of the service, the Provider has no obligation to save the files.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.9. The domain reactivation service after expiration will be sent to the user later if he wants to reactivate the domain after its expiration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.10. Users can pay using payment cards such as Visa, MasterCard, Maestro, Dina and American Express. Payments are made in dinars (RSD), and if paid in euros (EUR) or other currencies, the amount is automatically converted into dinars at the rate of the National Bank of Serbia. Also, the costs of the transaction are borne by the Provider, and refunds are made exclusively through the used payment methods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instant payment of the National Bank of Serbia - IPS scan<br>The online order can be paid by instant payment, using the IPS scan method. When IPS scan is selected, the customer will be redirected to a page where a one-time IPS QR code provided by Banca Intesa will be displayed. With the mobile banking application installed on his mobile device, the customer scans\/downloads the data from the generated IPS QR code and makes the payment easily, in the secure environment of his bank. Information about the outcome of the payment will be displayed to the customer immediately after the processing is completed on our website, but it will also be delivered to him via email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment by general money order or mBanking<br>Users can make a payment and a general payment slip at any payment point in the country or through the application of a bank operating in Serbia.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li id=\"5\">Service transfer<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. The user can transfer the service to another user by using the Client-Panel where, based on the entered email address to which he wants to transfer the service, that account will be automatically created and a verification email will be sent to the user to whom the service is transferred. If the user to whom the service is transferred accepts the service by clicking on the verification link, he becomes responsible for that service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.2. During the transfer, the person to whom it is transferred will have access to the email address that is making the transfer.<\/p>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li id=\"6\">Provider&#039;s obligations<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. The provider rents servers for the provision of web hosting and VPS servers from other companies, so it cannot be held responsible for any damage that happens to the servers and can only guarantee what the companies from which it rents servers guarantee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2 Za upravljanje uslugom Provajder Korisniku stavlja na raspolaganje jedan ili vi\u0161e kontrolnih panela: cPanel, softver tre\u0107e strane, i\/ili WHS Panel, softversko re\u0161enje koje razvija i odr\u017eava Provajder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2.1 Korisnik prihvata da slo\u017eeni softverski sistemi mogu sadr\u017eati programske gre\u0161ke i druge nedostatke koji se ne mogu u potpunosti predvideti ni otkloniti, kao i da automatizovani procesi mogu povremeno raditi sa zastojima.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2.2 WHS Panel se Korisniku ustupa na kori\u0161\u0107enje u vi\u0111enom stanju (&#8222;as-is&#8220;). Provajder ne garantuje da \u0107e WHS Panel ili bilo koja njegova funkcija u svakom trenutku raditi bez gre\u0161aka, prekida i nedostataka, a prijavljene gre\u0161ke otklanja u razumnom roku, prema njihovoj ozbiljnosti i uticaju na uslugu. Privremena nedostupnost pojedina\u010dne funkcije panela ne smatra se nedostupno\u0161\u0107u usluge hostinga ako sajtovi, e-po\u0161ta i podaci Korisnika ostaju dostupni. Provajder Korisniku ustupa neisklju\u010divo i neprenosivo pravo kori\u0161\u0107enja WHS Panela, bez prava podlicenciranja, isklju\u010divo radi upravljanja uslugama i za vreme trajanja usluge. Sva prava intelektualne svojine na WHS Panelu pripadaju Provajderu ili njegovim davaocima licenci; WHS Panel mo\u017ee sadr\u017eati komponente otvorenog koda koje se koriste u skladu sa njihovim licencama.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2.3 Provajder ima pravo da funkcije WHS Panela dodaje, menja ili uklanja radi razvoja, bezbednosti i odr\u017eavanja. Funkcije ozna\u010dene kao probne (beta) pru\u017eaju se bez garancija i mogu biti izmenjene ili uklonjene bez najave.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2.4 cPanel je softver tre\u0107e strane (cPanel, L.L.C.) i Provajder nema uticaj na njegov razvoj, ispravnost i dostupnost. Kori\u0161\u0107enjem usluge koja uklju\u010duje cPanel Korisnik prihvata i uslove licence cPanel EULA, dostupne na sajtu proizvo\u0111a\u010da, i saglasan je sa tim da: (a) cPanel, L.L.C. ne daje nikakve garancije u pogledu tog softvera; (b) cPanel, L.L.C. mo\u017ee po sopstvenoj oceni ukinuti, onemogu\u0107iti ili suspendovati kori\u0161\u0107enje softvera; (c) Provajder ne odgovara za gre\u0161ke, nedostatke i nedostupnost samog cPanel softvera, ve\u0107 u tom slu\u010daju Korisniku pru\u017ea razumnu pomo\u0107 i, gde je mogu\u0107e, alternativno re\u0161enje.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2.5 Odredbe ove sekcije ne isklju\u010duju niti ograni\u010davaju prava koja Korisnik koji ima svojstvo potro\u0161a\u010da ima po Zakonu o za\u0161titi potro\u0161a\u010da.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.2.6 WHS Panel se ne prodaje zasebno niti se za njega pla\u0107a posebna naknada; pravo kori\u0161\u0107enja WHS Panela sti\u010de se uz aktivnu uslugu i prestaje istekom ili prestankom usluge uz koju je odobreno. Odredbe ovih Uslova o WHS Panelu (princip &#8222;kakav jeste&#8220;, izmene, razvoj i ograni\u010denja garancija) shodno se primenjuju na sav drugi softver koji Provajder razvija i stavlja Korisniku na raspolaganje, uklju\u010duju\u0107i, ali ne ograni\u010davaju\u0107i se na, WordPress plugine, AI chatbot i prate\u0107e alate, osim ako je za pojedini softver ovim Uslovima druga\u010dije odre\u0111eno. WordPress plugini se pribavljaju kupovinom licence u skladu sa sekcijom 15, a AI chatbot usluga u skladu sa sekcijom 17.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.3. The provider performs domain registration services on behalf of the user using RNIDS and NameSilo and cannot guarantee anything more than they guarantee in their terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.4. The provider will carefully and will try to ensure maximum functioning by investing in additional security, making regular updates and communicating with software authors so that the performance of the server is at the highest possible level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.5. In case of any problem with the server, the client can, within 15 days from the moment of the problem with the server, request an annual report on how long the interruption was and if the availability was less than guaranteed, thereby getting a refund for the hosting service according to the table given below<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Availability (Uptime) Reduction<br>Above guaranteed availability 0%<br>Between 99% and guaranteed availability 10%<br>Between 95% and 99% 50%<br>Below 95% 100%<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.6. Provajder \u0107e biti odgovoran isklju\u010divo za gubitak koji je posledica nemara Prvajdera osim u slu\u010dajevima namernog nemara, odgovornost za \u0161tetu \u0107e biti ograni\u010den na direktan gubitak ukupnog iznosa koji odgovara iznosu naknade za teku\u0107i period pretplate. Provajder ne\u0107e biti odgovoran za indirektan gubitak kao \u0161to je gubitak profita, gubitak u prodaji, gubitak informacija ili korumpiranje informacija usled hakovanja kompijuterskih resursa provajdera od strane neovla\u0161\u0107enih tre\u0107eg lica.Ograni\u010denja odgovornosti iz ovih Uslova ne primenjuju se na \u0161tetu prouzrokovanu namerno ili krajnjom nepa\u017enjom Provajdera, ni na odgovornost prema Korisniku koji ima svojstvo potro\u0161a\u010da u meri u kojoj se po zakonu ne mo\u017ee isklju\u010diti ili ograni\u010diti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.7. The provider will store the user&#039;s data (account payer and invoices) even after the service expires, other information will be automatically deleted when the service is deleted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.8. The provider performs regular backups on a remote server with the use of specialized software for creating backup accounts in a certain period of time. The provider cannot guarantee that the backup will work correctly nor can it guarantee the operation of the software or the server because it is not the author or owner of both. The user is solely responsible for creating and securing backup copies of their account to be safe in case of any loss or problem. The time required to restore data from the backup server depends on third-party software and infrastructure and may cause extended downtime. This period is not counted in the uptime guarantee of 99.9%, and the Provider is not responsible for possible service interruptions during the restore process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.9. Provajder mo\u017ee u toku trajanja usluge trajno prestati sa pru\u017eanjem pojedine usluge. Korisnik \u0107e o tome biti obave\u0161ten najmanje 30 dana unapred i ima\u0107e vremena da preuzme svoje podatke i izvr\u0161i neophodne radnje pre ukidanja. Korisniku se vra\u0107a srazmerni deo naknade za neiskori\u0161\u0107eni period, odnosno za neiskori\u0161\u0107ene dokupljene jedinice, ili se na zahtev Korisnika taj iznos prenosi kao kredit za druge usluge Provajdera. Po isteku roka iz obave\u0161tenja podaci se trajno bri\u0161u. Ukidanje usluge po ovoj ta\u010dki, uz ispunjenje navedenih obaveza, ne smatra se povredom ugovora. Ova ta\u010dka se ne primenjuje na prekid usluge zbog kr\u0161enja Uslova od strane Korisnika.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.10. The provider will protect all user information in accordance with the Data Protection Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.11. The Provider has the right to check the User&#039;s account in order to reduce the risk of security breaches and ensure the proper functioning of the service. Also, the Provider has the right to make changes to the account if it believes that it will improve or increase the security of the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.12. The provider has the right to change the characteristics of the package (utilization of CPU, RAM, EP, IO) at any time without prior announcement and notification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.13. The provider cannot guarantee that the user will receive the e-mails he sends about the accounts or any notifications via e-mail, because he cannot influence the availability of the e-mail server and the reception of e-mails, and thus cannot guarantee it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.14. The provider is not responsible for service interruptions or extended downtime caused by force majeure, including but not limited to: natural disasters, hacker attacks, power outages, data center technical interventions, or third-party software and hardware limitations, such as the time required to restore data from backup servers.<\/p>\n\n\n\n<ol start=\"7\" class=\"wp-block-list\">\n<li id=\"7\">User obligations<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. The User is responsible for all information provided to the Provider when ordering the service and is obliged to ensure that the data is accurate and to use services that do not violate the rights of third parties or any law that applies in Serbia as well as in other countries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.2. The user undertakes not to attempt in any way to access information and accounts of other users and to access systems that are not part of his account without authorization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.3. The user is obliged to perform regular control of the software he installs on his account in order to prevent any malicious software from spreading malicious software, sending spam or any other abuse of the service he uses. Any damage caused to the user himself or to a third party due to the content on the user&#039;s account or by using the service personally, the user is responsible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.4. The user is obliged to inform himself about the expiration of the services and to take care of their renewal. The user is solely responsible if the payment is not verified within 48 hours (except in cases where there are holidays and non-working days) to submit proof of payment to the email address of the Provider with a request to renew the paid service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5. Agreeing to the terms of use of third parties<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The User agrees that by using the services provided by the Provider, he is also subject to the terms of use of the following third parties whose services we use to provide our services:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RNIDS<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NameSilo<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hetzner GmbH<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">cPanel<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LiteSpeed<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jetbackup<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cloudlinux and Imunify360<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5.1. Access to third-party terms of use<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For your information and ease of access, we provide links to the terms of use of these companies:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RNIDS<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NameSilo<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hetzner GmbH<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">cPanel<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LiteSpeed<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">JetBackup<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cloudlinux and Imunify360<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The user is obliged to familiarize himself with these conditions. The Provider is not responsible for any violation of the terms of use of these companies by the User.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5.2. Terms of Use Language<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The terms of use of said third parties may only be available in English or other languages. The provider is under no obligation to translate the terms of use of these companies. If the User has difficulties with understanding, we recommend that he hire a qualified translator or contact us for help in finding relevant information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5.3. User&#039;s Responsibility<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">User is responsible for compliance with all applicable terms of use and policies of said third parties. Any violation of these terms by the User may result in termination of service or other measures by the Provider or third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.5.4. The user independently decides on the installation, configuration and content of the Chatbot knowledge base.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.2. Nature and Limitations of the Service The User agrees and understands that the Chatbot generates responses automatically using artificial intelligence technologies, and that such responses may be inaccurate, incomplete or inappropriate. Chatbot does not represent legal, financial, medical or any other professional advice. The provisions of Section 10 of these Terms of Use also apply to the Provider&#039;s liability for AI-generated responses. The user is obliged to independently monitor the operation of the Chatbot and to take reasonable measures to verify the accuracy of the information that the Chatbot provides to its visitors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.3. Obligations of the User in terms of content The User is solely responsible for the content he enters into the Chatbot&#039;s knowledge base, as well as for all instructions and configuration. The user guarantees that the entered content: (a) does not violate the applicable regulations of the Republic of Serbia or the rights of third parties (including intellectual property rights), (b) does not contain illegal, offensive, misleading or harmful information, (c) does not contain personal data of third parties for the processing of which the User does not have an appropriate legal basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.4. Protection of personal data \u2014 roles of the parties With respect to the personal data of the User&#039;s visitors that are processed via Chatbot, the User has the status of handler, and the Provider has the status of processor in terms of the Personal Data Protection Act of the Republic of Serbia, i.e. the General Data Protection Regulation (GDPR) when applicable. The Provider processes personal data exclusively by order and on behalf of the User, to the extent necessary to provide the service, and applies reasonable technical and organizational protection measures. The user as a controller is responsible for determining the legal basis of the processing, for informing its visitors and, when required by law, for obtaining their consent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.5. Third parties and AI providers The user agrees and expressly accepts that, in order to generate responses, Chatbot forwards messages and related visitor data to third-party artificial intelligence service providers (e.g. OpenAI and similar), which may perform technological processing on servers outside the territory of the Republic of Serbia, including countries outside the European Union. The user undertakes to inform his visitors about this processing and the possible transfer of data abroad in an appropriate manner within the framework of his own privacy policy, and to provide the necessary legal basis for such processing. The Provider is not responsible for data processing carried out by third-party AI providers within their own terms of use, to which Section 7.5 of these Terms applies accordingly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.6. Prohibited Use The User is prohibited from using the Chatbot or enabling its use: (a) for the distribution of illegal, fraudulent, offensive or harmful content, (b) for intentionally deceiving visitors, including falsely representing the Chatbot as a certain natural person in a manner contrary to the regulations, (c) for sending unwanted (spam) messages or automated data collection contrary to the regulations, (d) for violating intellectual property rights or other rights of third parties, (e) for unauthorized access attempts, reverse engineering, overloading or disrupting the security and stability of the Service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.7. Availability and limitation of liability The Provider makes reasonable efforts to ensure the availability and proper functioning of the Chatbot, but does not guarantee the continuous availability of the service or the accuracy, completeness and appropriateness of the individual responses generated by the Chatbot. The provider is not responsible for damage caused by visitors&#039; or users&#039; reliance on Chatbot responses, nor for indirect, consequential or lost profits. The user, in relation to his visitors, is solely responsible for the way he uses the Chatbot and for the communication made through it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.8. Fee The fee for using the Chatbot service is determined according to the Provider&#039;s valid price list, and the provisions of Sections 4 and 9 of these Terms of Use apply to the calculation, payment and refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.9. Suspension and termination of service The Provider reserves the right to temporarily suspend or permanently terminate the provision of the Chatbot service to the User in case of violation of these Terms of Use, misuse of the service or behavior that threatens the security, stability or legality of the service, with an effort to notify the User beforehand, when possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.10 Free AI Chatbot \u2014 Duration and Inactive Accounts<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The free AI chatbot is a promotional service provided by the Provider free of charge. In order not to accumulate unused free accounts, the Provider reserves the right to remove or terminate them under the following conditions, with prior notification to the user via e-mail:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) A service that could not be set up. If at the time of activation the user&#039;s domain or website is not available, so the AI chatbot cannot be set up, the Provider will notify the user by e-mail. If the site does not become available within the subsequent period specified in that notification, the incomplete activation is removed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) Service without activity. If the AI chatbot is installed, but there is no recorded activity on the user&#039;s site for more than 30 (thirty) days (that is, the widget is not loaded because there are no visits or it is not installed on the site), the Provider will send a notification to the user. If there is no activity even in the subsequent period specified in the notification, the service is terminated. Poruke koje operater Korisnika pi\u0161e bez automatskog prevoda ne tro\u0161e kvotu. Mese\u010dna kvota osnovnog paketa obnavlja se po\u010detkom svakog obra\u010dunskog meseca i neiskori\u0161\u0107eni deo se ne prenosi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.13 Dokupljeni paketi AI poruka predstavljaju digitalni sadr\u017eaj koji se isporu\u010duje odmah po evidentiranju uplate, dodavanjem poruka na nalog Korisnika, \u010dime je isporuka izvr\u0161ena u celosti. Potro\u0161a\u010d koji je pri porud\u017ebini zahtevao trenutnu isporuku saglasan je da njome pravo na odustanak prestaje. Dokupljene poruke se sabiraju, ne isti\u010du dok je AI usluga Korisnika aktivna i tro\u0161e se nakon mese\u010dne kvote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.14 Deaktivacija chatbota zbog neaktivnosti (ta\u010dka 17.10) ne poni\u0161tava dokupljene AI poruke; one ostaju dostupne po ponovnoj aktivaciji. U slu\u010daju trajnog prestanka pru\u017eanja AI usluge od strane Provajdera, Korisniku se vr\u0161i povra\u0107aj srazmeran broju neiskori\u0161\u0107enih dokupljenih poruka.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.15 Dodatne opcije (uklanjanje oznake Provajdera, automatski prevod, pro\u0161ireno indeksiranje) va\u017ee za pla\u0107eni period. Istekom perioda opcija se automatski deaktivira: vra\u0107a se prikaz oznake Provajdera, prevod prestaje, a limit indeksiranja se vra\u0107a na podrazumevani.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17.16 Chatbot se obu\u010dava na sadr\u017eaju sajta \u010diji domen Korisnik navede pri porud\u017ebini. Korisnik garantuje da ima pravo kori\u0161\u0107enja tog domena i njegovog sadr\u017eaja i odgovara za \u0161tetu proisteklu iz neta\u010dnosti te garancije.
